Overview:

UK REACH is an adaptation of Regulation (EC) no 1907/2006 on the Registration, Evaluation, Authorisation and Restriction of Chemicals (EU REACH) that applies in Great Britain (GB = England, Scotland and Wales) from 1st January 2021.

As of 1st January 2021, the UK REACH and the EU REACH regulations operate independently from each other. Companies that supply and purchase substances, mixtures or articles to and from the EU/EEA/Northern Ireland and Great Britain (England, Scotland and Wales) will need to ensure that the relevant duties are met under both pieces of legislation.

UK REACH Regulation applies to the majority of chemical substances; those used in industrial processes and daily life, for example in cleaning products, paints as well as in articles such as clothes, furniture and electrical appliances.

Great Britain (GB) Market Access for Non-GB Manufacturer

Under Article 8 of UK REACH, a non-GB manufacturer/formulator/producer can appoint a GB-based Only Representative to fulfil the obligations of the GB-based importers. This helps maintain access to the GB market for their substances by reducing the responsibilities for importers.

As your GB OR, we can ensure continued access for your non-UK Company to the GB market:

• Submit Downstream User Import Notifications (DUINs) on behalf of your GB based pre-existing customers
• Submit inquiries and registrations to cover your new GB customers
• Act as your trustee, protecting your CBI whenever necessary

UK REACH Candidate List

Importers and producers of articles must notify the Agency (HSE) if substances listed on the Candidate List (the list of Substances of Very High Concern) are present in the article(s), under certain conditions:

a. The substance is present in those articles in quantities totalling over 1 tonne per producer or importer per year; and

b. The substance is present in those articles above a concentration of 0.1 % w/w
