New EU Toy Safety Regulation (EU) 2025/2509 – Prepare for the Transition Now
On 12 December 2025, the new EU Toy Safety Regulation (Regulation (EU) 2025/2509) was published in the Official Journal of the European Union. It will replace the current Toy Safety Directive 2009/48/EC and establish a directly applicable legal framework for toy safety across the EU.
With the publication of the regulation, the legal basis has now been established. In the coming years, the requirements will be further specified through harmonized standards, which may also introduce new testing methods. Until such standards are adopted, product testing will continue to be carried out in accordance with the existing standards based on the Toy Safety Directive.
Although the regulation will only fully apply from 1 August 2030, companies should already begin to familiarize themselves with the new requirements. The changes are extensive and will likely require adjustments to materials, product design, documentation, and supply chains.
Key Changes Introduced by the Toy Safety Regulation
The regulation introduces several important changes, including:
- Stricter chemical requirements
New bans and restrictions apply to substance groups such as bisphenols, PFAS (“forever chemicals”), and allergenic fragrances. Endocrine disruptors as well as certain respiratory and skin sensitizers will be generally prohibited for defined categories of substances. - Digital Product Passport (DPP)
In the future, key conformity and safety information – such as the CE marking, relevant test reports, and additional documentation – must be provided digitally and made accessible. - New obligations for online marketplaces
Online trade will also be more strictly regulated. Platform operators must ensure that non-compliant products are not offered and that CE marking, safety warnings, and the digital product passport are clearly visible to consumers.
Certain risk-related provisions have already applied since 1 January 2026. Full implementation of the regulation is required by 1 August 2030.

Guide for purchasing toys with educational value
The market for toys is becoming increasingly diverse and the product range is huge. It is very difficult for the consumer to assess or determine which products have an educational value. The TÜV Rheinland test mark with the keyword "Excellent Play Value" was established to provide information about the educational value of a toy.
For the new certificate, experts from TÜV Rheinland have been working with psychologists and educators to develop a minimum standard and an in-depth testing concept that goes beyond mechanical and chemical testing. The testing concept includes, for example, a separate weighting of the individual assessment criteria for each different age range. Testing takes into account factors such as whether a toy promotes the development of motor skills, language skills, or social interactions with other players. Other aspects include identity formation, self-control or the strengthening of self-confidence during play, and cognitive aspects such as the development of creativity or memory, as well as the motivation to play again.
A requirement for the certification of the play value is the conformity of the toy with the EU Toy Regulation (EU) 2025/2509.
