USA - Washington Adopted the Safer Products Restriction and Reporting Rules for Consumer Products

​On May 31, 2023, Washington State Department of Ecology adopted a new rule, Chapter 173-337 WAC - Safer Products Restrictions and Reporting. This new chapter implements a regulatory program to reduce toxic chemicals in consumer products and increase product ingredient transparency and becomes effective on July 1, 2023.

Starting from January 1, 2024, the following entities are required to comply with the reporting requirements and the first notification on or before January 31, 2025 the latest.

- PFAS in leather and textile furniture and furnishings intended for outdoor use
- Organohalogen flame retardants in electric and electronic products with plastic external enclosures, intended for outdoor use
- Flame retardants (EHDPP, IPTPP, TNBP, TCP and TPP) in recreational covered wall padding made from polyurethane
- Bisphenols in food can linings

New chemical restrictions in products are describe below:

Starting from January 1, 2025,

- No intentionally added PFAS in aftermarket stain-resistant and water-resistance treatments
- No intentionally added PFAS in carpets and rugs
- No intentionally added ortho-phthalates in fragrances in beauty products and personal care products
- Ortho-phthalates in vinyl flooring shall not be more than 1000 ppm (sum)
- No intentionally added organohalogen flame retardants in plastic external enclosures of TV and electronic display intended for indoor use
- Flame retardants (EHDPP, IPTPP, TNBP, TCP and TPP) in other recreational products made from PU foams shall not be more than 1000 ppm
- Alkylphenol Ethoxylates (APEO) in laundry detergent shall not be more than 1000 ppm (sum)
- No bisphenols in drink can linings, except TMBPF
- Bisphenols in thermal paper shall not be more than 200 ppm (sum)

Starting from January 1, 2026, 

- No intentionally added PFAS in leather and textile furnishing and furnishing intended for indoor use
- No intentionally added bisphenols in thermal paper

Starting from January 1, 2027,

- No intentionally added organohalogen flame retardants in plastic external enclosures of electrical and electronic products for Group 1 (Large business)

Intentionally added amount means total bromine (Br) and total chlorine (Cl) are above 1000 ppm each and total fluorine (F) is above 1000 ppm with total phosphorus (P) less than 5000 ppm.

Starting from January 1, 2028,

​- No intentionally added organohalogen flame retardants in plastic external enclosures of electrical and electronic products for Group​ 2 (Small business)

Intentionally added amount means total bromine (Br) and total chlorine (Cl) are above 1000 ppm each and total fluorine (F) is above 1000 ppm with total phosphorus (P) less than 5000 ppm.​
