USA - New York Bans Organohalogen Flame Retardants in Certain Consumer Products

​New York enacts the family and fire fighter protection act relating to the regulation of chemicals in upholstered furniture, mattresses and electronic enclosures. It bans the use of certain flame retardants, e.g. organohalogen flame retardants, in such furniture and mattresses and also in electronic casing of electronic displays.

It is prohibited to place in the State upholstered furniture or mattress or its constituent component that contains any intentionally added halogenated, organophosphorus, organonitrogen or nanoscale flame retardants and the ban will come into force on December 1, 2024. However, the ban is not going to cover the electronic components of upholstered furniture and mattresses.

The new act is also prohibiting any intentionally added organohalogen flame retardants using in the enclosure or stand of any electronic display. The ban will also come into force on December 1, 2024.​

The manufacturer of electronic display shall submit an annual report to the Department one year after the effective date (i.e. January 1, 2023) identifying all of the flame retardants used in the enclosure of stand of the electronic display otherwise the products cannot be sold in the State.​
