USA - Michigan Proposed a PFAS Reporting Rule
A bill (SB 217) regarding the report of products containing perfluoroalkyl and polyfluoroalkyl substances (PFAS) was introduced by Senators in Michigan State on March 10, 2021. SB 217 requires consumer notification if consumer products or packaging contains PFAS.
Consumer product or product are defined as an article or component part that is produced, distributed, or sold for the personal use, consumption, or enjoyment of a consumer, including, food and water.
The proposed reporting rule requires manufacturers, producers, packagers, importers, suppliers or distributors of a PFAS consumer product / packaging to provide a label with a warning statement "the product / the product's packaging may includes PFAS and that exposure to PFAS may have adverse health effects" and any other relevant requirements imposed by the department. The label shall be printed on or affixed to a product or its packaging.
Moreover, a written notice shall be provided directly to the authorized agent for a retail seller annually with the following information:
- a statement "product or the product's packaging may result in exposure to PFAS
- name of the product or universal product code
- the product label with the warning statement and other relevant information stated above
A written confirmation of receipt of the notice shall be obtained from the retail seller.
