USA - California Plans to Restrict PFAS in Products for Children

California proposed a bill (AB 652) prohibiting a person, including a manufacturer, from selling or distributing in commerce any new juvenile product that contains regulated perfluoroalkyl and polyfluoroalkyl substances (PFAS).

It would cover products designed for use by infants and children under 12 years of age, such as, a baby or toddler foam pillow, bassinet, bedside sleeper, booster seat, changing pad, child restraint system for use in motor vehicles and aircraft, co-sleeper, crib mattress, floor playmat, highchair, highchair pad, infant bouncer, infant carrier, infant seat, infant sleep positioner, infant swing, infant travel bed, etc. The product or its components must not contain PFAS at or above 100 ppm (measured in total organic fluorine).

However, the bill does not cover the following product categories:

- Children's electronic product
- Medical device
- Internal component of a juvenile product (i.e. inaccessible part)

The proposed implementation date is July 1, 2023.
