Netherlands - Amended Commodities Act (Regulation on Packaging and Consumer Products) on Food Contact Materials and Articles

​On June 20, 2025, the Netherlands Ministry of Health, Welfare and Sport published on official Gazette, a new amendment addressing food contact materials (FCMs) under the nation's Commodities Act, specifically the Regulation on Packaging and Consumer Products. This amendment, issued by the State Secretary for Health, Welfare and Sport on June 12, 2025 (reference 4131373-1083806-WJZ), updates the regulation, which is effective from July 1, 2025 onward.

The changes, outlined in Part A of the Annex to the Regulation, include:

  • Updated substance requirements: Revisions to the use and specifications of substances, including adjustments for phthalates and metals.
  • Harmonized migration limits: Specific migration limits (SML) for certain substances have been aligned with those in the EU's Regulation (EU) No. 10/2011 on food contact plastics
  • Technical corrections: Changes include technical updates, such as revising the term "butyl benzyl phthalate, containing not more than 1% dibenzyl phthalate" to "benzyl butyl phthalate, containing not more than 1% dibenzyl phthalate."​

Packaging and consumer goods that meet the requirements of the Commodities Act Regulation on Packaging and Consumer Goods as of June 30, 2025, and are placed on the market before January 1, 2026, can continue to be sold until existing stocks are depleted.
