Montenegro - Regulation on Materials and Articles Intended to Come into Contact with Food
The Regulation on materials and articles intended to come into contact with food, was published in the Official Gazette of Montenegro No. 91/2026 on June 29, 2026, and became effective on July 7, 2026.
It is one of the implementing regulations linked to the Law on Food Safety (Official Gazette No. 59/2026). It replaced the prior framework regulation from Official Gazette No. 80/2016, which had already transposed core elements of EU Regulation (EC) No 1935/2004.
Consistent with the previous Montenegrin framework and EU Regulation (EC) No 1935/2004, the regulation covers materials and articles (including active and intelligent materials and articles) that, in their finished state:
- are intended to come into contact with food, or
- are already in contact with food, or
- can reasonably be expected to come into contact with food.
This includes packaging materials, utensils, equipment, and other items used in the production, preparation, treatment, storage, transport, or serving of food. Specific groups of materials (e.g., plastics, ceramics, regenerated cellulose film, recycled plastics) are subject to additional detailed rules set out in separate rulebooks.
The core obligations closely follow the EU framework approach.
- Manufacture in accordance with good manufacturing practice (GMP) so that, under normal or foreseeable conditions of use, constituents do not transfer to food in quantities that could endanger human health, cause an unacceptable change in food composition, or deteriorate organoleptic properties.
- Labelling requirements (typically the glass-and-fork symbol or equivalent wording indicating suitability for food contact, plus any special instructions for use).
- Traceability throughout the supply chain.
- Declaration of compliance (DoC)
- Compliance with any specific measures adopted for particular material groups.
- Prohibition on misleading labelling, advertising, or presentation.
