Malaysia - Proposed New Communications Equipment Framework
In May 2024, Malaysian Communications and Multimedia Commission(MCMC) opened a public consultation on New Communications Equipment Framework (NCEF).
Under the proposed NCEF, there are requirements for supplier and communications equipment registration, for example:
- Registration of supplier will be based on whether the supplier intends to use communications equipment for commercial or non-commercial activities.
- The registration of communications equipment will be based on the classification of communications equipment according to potential risks, which consists of scheme A (high-risk), scheme B (medium-risk) and scheme C (low-risk). In addition, communications equipment may also be subjected to special approval, exemption or prohibition.
- The proposed operating model of NCEF provides a clear demarcation of roles between MCMC and Certifying Agent.
- Proposed revision of the Communications and Multimedia (Technical
Standards) Regulations 2000, to address certain challenges in dealing with the sales of communications equipment on ecommerce platform, potential false declaration of compliance by suppliers as well as enhancing market surveillance activities.
