France - Law No. 2026-602 of July 8, 2026 Aimed at Reducing the Environmental Impact of the Textile Industry
The law to reduce the environmental impact of the textile industry was published on July 8, 2026. This law applies to “ultra-express fashion” (ultra-express mode) practices for:
- Textile clothing products
- Shoes
- New household linen for private individuals
- New textile products for the home
Second-hand / used product sales are excluded.
“Ultra-express fashion” is defined by two cumulative criteria:
- Placing a large number of new product references on the market, and
- Low incentive to repair the products.
From 1 September 2026, eco-contributions under the EPR scheme are modulated for ultra-express fashion products. The modulation can take the form of a penalty.
Penalty amounts increase over time:
– 2026: €0.25 to €12
– 2030: €2.20 to €20
Penalties cannot exceed 50 % of the product’s sales price excluding tax.
Products subject to these penalties are not eligible for environmental performance bonuses.
Additionally, the tax reduction previously available for donating unsold goods to associations (under Article 238 bis of the General Tax Code) is abolished. Producers can no longer claim this tax benefit.
In addition, the advertising will also be supervised. From January 1, 2027, it will be forbidden to advertise ultra-express fashion products or to promote them directly or indirectly. It will be forbidden to use the term « free » in a marketing operation.
Online interface operators selling or delivering ultra-express fashion products must display clear, legible messages (same character size as the price and placed close to it) that:
- Encourage sobriety, re-use, repair and recycling of products
- Inform about the social impact of the product
- Raise awareness of the product’s impact on the environment and human health
- Provide information on the environmental impact of the proposed delivery service
They must also display the manufacturing locations of the products sold online.
