Europe | The EU Court of Justice has Overturned the Classification of Titanium Dioxide as a Carcinogen

​In 2020, the European Commission classified titanium dioxide as a potential carcinogen when inhaled in powder form (containing 1% or more of particles ≤10 μm in diameter).
This decision was challenged by manufacturers, importers, and suppliers in the General Court of the EU.

In November 2022, the General Court ruled in favor of the challengers, annulling the classification. The court found that the EU Commission had made a significant error in assessing the reliability of a key scientific study used to support the classification.

Both France and the EU Commission appealed against the decision, but their appeals were dismissed by the Court of Justice in its latest ruling on August 1, 2025.
As a result, the original classification of titanium dioxide as a carcinogen has been upheld as annulled.
