Europe | Regulation 2025/843 Amending Annex I of the POP Regulation with Regard to UV-328
On July 15, the EU Commission has published Regulation (EU) 2025/843 amending Part A of Annex I to the POP Regulation regarding the use of 2-(2H-benzotriazol-2-yl)-4,6-di-tert-pentylphenol (UV-328).
· Annex XIV to REACH includes UV-328, with a latest application date on May 27, 2022 and a sunset date on November 27, 2023.
· No application for authorization was submitted. In absence of an authorization under Regulation (EU) No 1907/2006, UV-328 cannot be used in the EU, but it can still be imported in articles.
· UV-328 is used in surface coating, light stabilizer in plastics e.g. outdoor furniture and personal care products.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
To allow laboratories to improve the accuracy of relevant analytical methods and to ensure their uniform and adequate application, the unintentional trace contaminant limit should be set at 100 mg/kg at the entry into force of this Regulation, at 10 mg/kg two years after the entry into force and at 1 mg/kg four years after the entry into force.
The limit for UV-328 in Substances, Mixtures and Articles
a) 100 mg/kg (0,01 % by weight) from August 4, 2025,
b) 10 mg/kg (0,001 % by weight) from August 4, 2027,
c) 1 mg/kg (0,0001 % by weight) from August 4, 2029
