EU - Draft Commission Regulation (EU) Regards Terphenyl, Hydrogenated as a Substance, a Constituent of Other Substances, in Mixtures and in Articles

​This draft Regulation intends to introduce a new entry to Annex XVII to Regulation (EC) No 1907/2006. It intends to restrict the use and placing on the market of terphenyl, hydrogenated as a substance on its own or, where present in a concentration greater than 0.1 % by weight, as a constituent of other substances, in mixtures, or in articles or any parts thereof.

Proposed permanent derogations include:

(i) uses of PHT as a heat transfer fluid in the temperature range of 250˚C to 350˚C at industrial sites that have implemented strictly controlled closed systems to prevent PHT emissions; and

​(ii) defense applications. The application of the proposed Regulation is deferred by 18 months, except for civilian aerospace applications, where a 10-year transitional period is proposed.
