Quiz 2012 by TÜV International GmbH - Unternehmensgruppe TÜV Rheinland

This quiz is promoted by TÜV International GmbH - Unternehmensgruppe TÜV Rheinland, 51105 Cologne, Germany (in the following referred to as ‘the provider’).

Only customers 21 years of age or over and domiciled in Belgium, France, Greece, Spain, Italy, Netherlands, UK and Portugal are allowed to participate.

Customers wishing to participate in the quiz are requested to subscribe for each of the four periods mentioned below. Participation only covers one single period. Participants are of course free to register for each of the four periods. All they need to do is to fill in the registration form giving their first names and surnames, country of residence as well as valid email address. Finally entrants tick one of the two boxes on the current landing page for each period and declare their acceptance of the terms and conditions.

There is a choice of four periods:

• 1. January to 31. January 2012
• 1. May to 31. May 2012
• 1. August to 31. August 2012
• 1. December to 31. December 2012

All employees of TÜV International GmbH - Unternehmensgruppe TÜV Rheinland, those involved in the development and implementation of the quiz, and their relatives are excluded from participation.

• December: TÜV Rheinland Ballpoint Pen

In each period, three winners per country will be drawn from the replies returned to us.

The winners’ names will be displayed as soon as the 4 week quiz periods have expired, i.e. on 1 February 2012, 1 June 2012, 1 September 2012, and 2 January 2013. The information will be available online at the email address that has been stated in the registration form for the quiz. The winners agree to have their names and places of residence published by the provider. The prizes will be sent by post. The claim to the prize is not transferable to other persons or companies.

No cash reimbursement is possible.

The provider reserves the right to exclude invalid or manipulated entries without giving any reasons.
The privacy policy (data protection agreement) of TUV Rheinland AG must be observed!

If the winner cannot be identified or if the prize remains unclaimed one week after the publication of the winner’s name by the provider, the winner will be taken to have forfeited any right to the prize.

Premature termination

The provider reserves the right to prematurely terminate/to suspend/to terminate the quiz scheme at any time without prior notice. This applies in particular true if the quiz cannot be held on schedule for any reasons, for instance technical and/or legal reasons that affect the administration, security, integrity and/or regular and proper execution of the quiz. In such cases, the provider shall have the right to modify the quiz scheme at its absolute discretion.

Recourse to courts of law

Any recourse to courts of law is excluded. There is no actionable claim on the part of the winners on the delivery of prizes (Section 762 BGB (German Civil Code)). The provider does not assume any responsibility for loss or damage caused to the prizes when being sent by post.

Limitation of liability

The provider shall not be liable for loss, delay, modification, manipulation and/or misrouting of emails and/or data during data entry, collection, transmission and/or storage, when the cause lies in third party data networks, especially the Internet and the WWW, third party telephone lines and/or different hardware and/or software which is/are being used by the participants and/or other third parties; this applies in particular to incorrect, missing, lost, deleted or corrupted data. Nor shall the provider be liable for incorrect information that is furnished by the participants and/or third parties, caused by the participants’ and/or third parties’ hardware and/or software and which may be used for the purpose of the quiz or in connection therewith. In particular no liability will be accepted if emails or data entries (into masks provided by TÜV International GmbH - Unternehmensgruppe TÜV Rheinland) will not meet the relevant requirements stated there, and consequently are not accepted and/or processed by the system. Furthermore, the provider shall not be liable for theft or destruction of the systems storing the data and/or the storage media nor in case the participants or third parties modify without permission and/or manipulate data contained in the systems and/or on the storage media.

The provider shall not be liable for damage or injury the winners or their relatives may suffer in connection with the prize. The liability for intent and gross negligence will not be affected by that.
