§ 1 Area of application
(1) The ordinance regulates the specific rights and duties of suppliers of telecommunication services for the public and those who contractually make use of or demand these services (customers).

§ 5 Connection price calculation
When invoicing, the suppliers must observe the following basic principles:

  • 1. The duration of time-dependent connections for telecommunications services according to tariff for the public shall be determined under regular adjustment with an official time standard.
  • 2. The systems, processes and technical facilities with which the conversion of the connection data registered in accordance with item 1. is effected, shall be subjected by the supplier to regular controls with respect to their accounting precision and conformation with the contractually agreed payments including the zoning data.
  • 3. The preconditions according to item 1. as well as accounting precision and correctness of payments of the data processing facilities in accordance with item 2, shall be ensured by a quality assurance system or be inspected once a year by sworn, publicly-appointed experts or comparable agencies. In order to provide evidence of the fulfilment of these obligations, the test certificate of an accredited certification body for quality assurance systems or the test result of a sworn, publicly-appointed expert shall be submitted to the regulating authority.

1. What does the Telecommunication Customer Protection Ordinance (TKV) § 5 mean?

The Regulatory Authority for Telecommunications and Postal Service (Reg TP) must receive a test certificate annually, which, among other things, confirms the accounting precision and the correctness of the invoicing to the customers.

2. Who is responsible for observation of the official ordinance?

The official ordinance is addressed to all those who offer telecommunications services to third parties.
Of course, the manufacturers of the accounting software used are also responsible for the fulfilment of the official ordinance.

3. What time frame must be observed?

For the first time, a test certificate should be submitted to the Reg TP by 31.12.2000 at the latest, and/or 15 months after the start of business at the latest.

4. What do you need to do at the moment?

You or the manufacturer of your accounting software should seek a partner like TÜV Rheinland Product Safety GmbH, Cologne, which is able to conduct the necessary inspections of accounting with practical orientation and competence.
