Germany's new Equipment and Product Safety Act

Since May 1, 2004, the German Equipment and Product Safety Act (GPSG) is into force. It regulates how technical equipment and consumer products are put into the market. What exactly does that mean and especially for you as a manufacturer?

What means that for you?

• A product may only be put into the market if the users health and safety are not endangered.
• Manufacturers and importers must inform consumers of all relevant safety information relating to the product.
• The name of the manufacturer or im-porter, the detailled adress as well as the product designation must be clearly identifiable.
• The manufacturer must keep a close watch on his product’s life cycle, informing the relevant authorities in the event of defects coming to light, and initiate a product recall if need be

The GPSG applies to:

• Technical equipment (equipment intended solely for use at work)
• Consumer products (goods or products intended for and used by them)
• Plant that requires inspection (boilers, elevators, etc.)
• In the future, it will be possible to issue GS marks for products for which this was previously not possible, such as furniture of all kinds, baby goods, textile products, etc.
