Consulting for the purchase and conversion of systems

Caution is called for in that you do not make yourself legally the marketer when you are the system buyer.

When buying a system, before the contract is concluded, all issues relating to requirements of implementation and responsibilities should be clarified by the buyer in his or her own interest. This should include ensuring that the current requirements of EU law on marketing are a part of the contract.

For legal reasons, this is necessary since the party who markets a system is also responsible for product safety. In addition, the following questions should, for example, be answered:

  • are all the implementations and standards in respect of the state of the art included in the tender?
  • have all appropriate EU standards taken into account in the contract?
  • is there confirmation from a notified body for deviations?
  • are the registered offices of the manufacturer in Europe or not?
  • is there a representative / authorized person (for reasons of product liability)?

What needs to be taken into account when converting and marketing your lift?

European law for marketing lifts as well as the Directive on Lifts have an effect on safety-relevant implementation and testing after major modifications and changes. Corresponding to the Law on Equipment Safety [GSG § 2 No. (3)], the procedure on marketing is to be applied when:

  • marketing new machines and lifts
  • (re)marketing after upgrading and
  • (re)marketing after major changes.

The Directive on Machines as implementation of the Guideline on Machines or the 12th GSGV for implementing the Directive on Lifts applies to marketing within the meaning of the Law on Equipment Safety, i.e. also to marketing after upgrading and major modifications.

What is important in conversion planning?

Correct conversion is becoming increasingly difficult because so many aspects must be taken into account. There is now a conversion catalogue for these questions. This catalogue includes the necessary measures which must be taken as well as others in the event of modifications of a component on an existing lift system.
